BM Injury Group secure compensation to cover clients medical care following workplace injury

Due to the unexpected physical nature of a work placement, John* suffered a hernia and contacted our Personal Injury team for assistance.

His case was investigated by experienced Personal Injury Senior Associate, James Wood, with a settlement being reached to enable John to have surgical options to aid his recovery.

John undertook a work experience role as part of a training scheme that he was told would be administrative. However, when he arrived at the placement the job had very little administration involved and proved to be very physically demanding. John, who is in mid-50s, had not undertaken any manual handling work before and was surprised at the nature of the work involved. As a result of the tasks that he was asked to perform he experienced pain and was diagnosed with a hernia by his GP.

“It was life changing,” commented John. “The hernia is painful and needs an operation to fix.  There are associated risks and long term potential dangers that I now need to consider. I have had to adjust my lifestyle as general day to day tasks like bending or lifting are uncomfortable.  I’m having to manage my lifestyle and the activities I do appropriately.”

Liability and causation were disputed by the provider of his work placement, which meant that it was a far from straightforward case but thanks to the tenacity of James, the case was settled a week before going to court.

“James was very, very positive and persistent, he kept me going when I felt overwhelmed by the situation,” said John. “He overcame any obstacles in the way of my case and achieved the result we wanted.”

The case was settled out of court with John agreeing to a settlement figure which gives him access to different options for treatment of his hernia.
