Long awaited Public Contract Regulations issued for consultation.

On 19 September 2014 the Cabinet Office issued the draft Public Contracts Regulations 2015 together with a consultation document on the transposing of the New Public Sector Directive into UK law. 

The Cabinet Office is soliciting comments on the long-awaited draft Regulations and the consultation runs for 4 weeks from 19 September to 17 October 2014.

Subsequent consultations relating to the new Utilities Directive and Concessions Directive will be issued in the near future.

The Government is still aiming to implement the new Directive for all procurements, earlier than the 2 years required by the EU. This does not include clinical services and until 18 April 2016 in England, commissioners of clinical healthcare services will continue procure these under the existing Part B service regime and the Procurement Choice and Competition Regulations 2013.

We know not to expect any gold plating in these Regulations and we do not expect much deviation from the New Public Sector Directive.  We are nevertheless interested to see the form that it is intended these new Regulations take and watch this space for our views and comments as and when we have absorbed and considered the new draft Regulations.
