Changes for employers of Bulgarian and Romanian nationals

In recent weeks, the topic of Bulgarian and Romanian nationals' access to the UK labour market has been widely covered and discussed in the news.

We have covered the changes that were scheduled to come into force on 1 January 2014 in our November update.

Considering the attention the topic received, it may be worth clarifying that the restrictions on employing Romanian and Bulgarian nationals ceased to apply on 1 January as planned.

Romanian and Bulgarian nationals now have the same rights to work in the UK as other EEA citizens – excluding Croatian nationals who continue to require worker authorisation.

Despite the changes coming into effect, the government continues to consider options for introducing the cap on EU migrants coming into the UK as well as limiting the benefits available. Notwithstanding, as things currently stand, the free movement for EEA citizens rules remain in force.
