Income rules for spouse visas

Lisa Parsons, senior associate at Blake Morgan comments on today's judgement to uphold income rules for foreign spouses:

"The decision will mean that in the long run there will still be non UK spouses who cannot obtain permission to come to  the UK to join their spouse.

Whilst this is disappointing, the court did however take the view that alternative sources of funding to evidence the minimum income requirement should be taken into account, under Article 8 of the European Convention on Human Rights.

The court has also made it clear that any Home office decision must take into account the best interests of children. Overall in my view this is a victory for campaigners who have campaigned hard against what are perceived as harsh rules which divide families and often do not take into account the best interests of children."
