Final TUPE amending regulations published
Since the Government set out its proposals to make changes to the Transfer of Undertakings (Protection of Employment) Regulations 2006 in September, it published draft regulations in December, and has now laid the final amending regulations before Parliament.
They will come into force on 31 January 2014.
Most of the changes will be effective for TUPE transfers which take place on or after 31 January. There are two notable exceptions to this:
- the new timescale for notifying employee liability information 28 days before the transfer (instead of 14 days before) will apply in relation to a transfer which takes place on or after 1 May 2014;
- microbusinesses (employing fewer than 10 employees) may inform and consult directly with affected employees in relation to a transfer which takes place on or after 31 July 2014.
The final regulations do differ from the draft regulations that were published in December.
