This presentation discusses the Court of Appeal decision in Gosvenor London Ltd v Aygun Aluminium Ltd  EWCA Civ 2695, where Mr Justice Fraser’s first instance decision to stay judgment enforcing an adjudicator’s decision on the grounds that there was a risk of dissipation of the adjudicated sum was upheld – adding new principle “g” to those previously summarised in Wimbledon v Vago. The presentation looks at the implications of the decision where issues of fraud or dissipation are raised in the enforcement proceedings.
Tim Sampson (2000) and David Sawtell (2005), both of Lamb Chambers, appeared for the successful respondent in the Court of Appeal, while Tim also appeared for the respondent at first instance. Both counsel specialise in legally complex construction disputes.
