Open Source Software
We have advised NHS bodies on the potential benefits of using Open Source software solutions, and looking at any commercial and legal risks of their use. Our work has included advice on public procurement issues, implications of the lack of warranties and indemnities; and advice on the risks of developing and using in-house developed tools compared to externally procured solutions’, and options to extend deployments for use within shared services as part of an integrated healthcare service.
Systems Procurement – NHS Foundation Trust
We advised a leading NHS Foundation Trust on a project to re-procure a software system capable of hosting and managing patient data capable of being accessed and used by multiple agencies to support patient treatment as part of an end of life care plans. We advised on the procurement options to ensure flexible delivery options in light of the budgetary constraints for the Trust but allowing for future development as further funding was secured, and to deliver the solution against a tight timetable to coincide with the decommissioning of the legacy system. We were involved in detailed negotiations with the bidders during a competitive tender process to ensure that the Trust had a robust risk management profile, without increasing the overall financial envelope for the Trust and securing good value for money.
Systems Procurement – Private sector provider
We have recently advised a private sector provider on the grant of licenses for patient management software to support cancer care services into a hospital. The hospital had a narrow approach to risk and originally placed all of the project and operational risk onto our client. We worked with the client to develop negotiation strategies to enable the risk profile to be more fairly distributed between the parties and enable each party to manage those risks more effectively. This reduced the overall risk profile for our client, while maintaining the high standards of care around patient data and service availability that the hospital was seeking.
