When will an employee working abroad be protected by UK employment laws?

Holly Cudbill, Associate in our Employment Law team, discusses the recent Employment Appeal Tribunal (EAT) case of Green v SIG Trading, which provides a helpful reminder of the factors to be considered in determining whether an individual working abroad can be protected by UK/GB employment laws.

With an increasingly globalised workforce, the question of 'territorial jurisdiction' crops up more and more frequently for employers, and this case highlights some of the factors the courts will consider when determining whether the individual has a stronger connection to the country they work in or to the UK.
