Darryn is an Associate in Blake Morgan’s Insolvency & Business Support team. Darryn’s background includes dealing with predominantly property dispute-related matters for 17 years, he has over 4 years’ specialist experience working for insolvency practitioners, companies, lenders, directors and private individuals dealing with litigious proceedings, transactional instructions and general advisory work in the context of both personal and corporate insolvency procedures.

Darryn’s transactional experience relates to assisting insolvency practitioners realise a company’s business or assets or assisting third parties acquire those assets from officeholders.

On the contentious side, Darryn has acted on a variety of contentious proceedings, typically for insolvency practitioner clients pursuing, or acting for directors or individuals defending, antecedent transactions (such as transactions at an undervalue, unlawful preferences, wrongful or fraudulent trading, director loans)  in both liquidation and bankruptcy contexts.

Main areas of practice

Corporate Insolvency

Acting for administrators on the pre-pack sale of one of the UK’s largest multi-site decorative trade finishing specialists in relation to a number of issues affecting the administration including validity of appointment, a pre-pack asset and business sale, advising the administrators’ of their obligations under The Goods Vehicles (Licensing of Operators) regulations 1995, assessing several retention of title claims, undertaking a security review in relation to qualifying floating charge holders and advising administrators in relation to the status of a charge and dealing with licences to occupy the multiple sites and assisting the administrators with the aggrieved landlords.

Acting for a newly formed company in relation to agreeing a licence to trade with the liquidators to enable the company to use the prestigious trading name to provide bespoke chinaware internationally.

Acting for administrators in relation to the negotiation of a post appointment sale of the assets of a consultancy and development business which designed and built high quality digital products for start-ups and innovators including ad hoc advice concerning the Administration (Restrictions on Disposal etc. to Connected Persons) Regulations 2021 and the Information Commissioners Office.

Acting for a creditor in Denmark in relation to a retention of title claim relating to the administration of a nationwide home improvement and garden centre retailer.

Acting for a specialist real estate funder in the enforcement of their security in relation to numerous connected entities and subsequent appointment of administrators, predominantly in the hotel and leisure sector.

Personal Insolvency

Advising a Trustee in bankruptcy in relation to jurisdiction and Chapter 15 proceedings regarding a property situated in the USA and Third Party liability costs orders.

Property Receiverships

Assisting secure lenders in relation to enforcement and recovery via appointment of administrators, personal guarantee enforcement and appointment of LPA Receivers.
