Mitigating the risks when employees leave
Depending on the circumstances, employers can face the risk of serious damage to their interests caused by departing employees. Challenging areas could be related to breaches of confidentiality, data security, leavers joining competitors, solicitation of clients and/or colleagues, knowledge loss, operational disruption, and negative publicity/reputational damage.
In the webinar, Employment Partner Rajiv Joshi will be joined by Hannah Clipston (Commercial Litigation Partner) and Jane Biddlecombe (Legal Director in Employment).
They will:
- Discuss practical considerations regarding risk management – starting from the commencement of employment, as well as steps to take during and after employment terminates.
- Consider ways that employers can protect against damage to their reputation, negative publicity, and options available in respect of legal action.
- Discuss the drafting and enforceability of post termination restrictions and confidentiality clauses, including practical legal steps available when breached.
- Consider data protection related issues, including customer data, financial records and intellectual property.
- Cover other impacts of departing employees on an employer.
As well as discussion and insights from Rajiv, Hannah and Jane, there will be time for you to ask questions.
