Blake Morgan delivers practical Health Tech expertise
Blake Morgan’s technology lawyers draw on their technical healthcare expertise, having advised NHS providers, commissioners, NHS England, as well as healthcare regulators, to support the development and commercialisation of technology solutions to challenges in the healthcare sector.
We work with a number of providers developing apps, online tools, patient monitoring and other data services explaining the legal and UK healthcare frameworks, enabling them to bring their ideas to market.
We also support established private sector businesses that provide technology equipment and services in the health sector, offering a full range of business support, including identifying and protecting intellectual property, drafting or negotiating contracts, supporting staffing issues and raising money through debt, investment and IPO listing.
Main Areas Of Practice
Our team of technology lawyers combines experience dealing with established and emerging technologies with knowledge and insight into the healthcare market including:
Apps and Web services
We work with developers to understand the legal risks associated with running apps and how to structure and manage those risks within the function of the app, as well as appropriate terms and conditions. We advise on data collection, use and sharing issues when handling sensitive patient medical data, to ensure compliance with GDPR requirements.
IT Platforms and Data Licensing
Enabling better data access and exchange between healthcare providers and systems to support patient outcomes is a key commercial healthcare ambition. We have advised on the structure, legal frameworks and risks as well as commercial contract terms, to enable the establishment of a number of unique data pooling and licensing arrangements to facilitate improvements in patient care.
Exploitation of Intellectual Property
We enable clients to protect and exploit innovation through licensing, joint venture and collaboration to take good ideas to a commercial solution.
Procurement of Technology
Our specialist team of commercial lawyers regularly advises the public sector on all aspects of conducting a procurement to ensure a robust and compliant process is followed. This experience is invaluable to the advice we provide to our private sector clients who are responding to and participating in a tender process.
We work with individuals developing apps in their spare time, new businesses and technology spin-outs from universities and other public sector organisations, as well as established technology providers selling into the public and private healthcare market.
We have advised a number of GPs who have developed apps to enable better access to GP services, private patient services and related support services. Drafting terms and conditions, and advising on patient confidentiality and GDPR compliant data protection policies and procedures.
Our Healthcare Technology team has supported a number of initiatives in the London health economy to create digital information exchanges to support various treatment initiatives designed to deliver improved patient care through timely, robust and secure access to patient data.
We acted for a private sector internet of things company with expertise in the commercialisation of data monitoring devices, in a collaboration with a university and FT to commercialise devices for monitoring different medical conditions. We negotiated with the university spin-out office for an exclusive licence of the associated IP to enable our client to commercialise the products.
