Landmark ruling on the meaning of ‘unfavourable treatment’

Matthew Smith and Tom Shears (instructing Keith Bryant QC and Saul Margo of Outer Temple Chambers) have successfully defended Swansea University and the Trustees of its pension scheme in an appeal in the Court of Appeal in the leading case on what amounts to "unfavourable treatment" in disability discrimination."

In People Management Daily Matthew explains why the Court of Appeal ruled that an employee had not been unfavourably treated because of something arising in consequence of disability, in the award of an ill-health early retirement pension based on the employee's reduced hours following a reasonable adjustment.
